Uninsured and Underinsured Motorist Accidents
We Help the Injured Recover Financial Compensation
When there's a car accident, damages are usually paid for by the insurance company of the negligent driver. But when that driver doesn't have insurance—or not enough—things get more complicated. The car accident attorneys at Ausman Law Firm, P.C., L.L.O. can help you recover damages if you've been injured by an uninsured or underinsured driver.
An experienced Omaha uninsured accident lawyer at our firm can review the details of your case and explain your available legal options. That way, you can make informed decisions about what to do after a car accident caused by an uninsured or underinsured driver.
What are the car insurance laws in Nebraska and Iowa?
The state of Nebraska requires all drivers to carry auto insurance with uninsured motorist/underinsured motorist (UI/UIM) coverage. If the negligent driver was uninsured, we can help you pursue a claim for damages with your own insurance company.
If the negligent driver was underinsured, we can pursue a claim for damages with the negligent driver's insurance company, up to the amount of coverage on the policy. We can seek the rest from your own insurance company. However, the amount of compensation you can receive from your insurance company is limited by the amount of coverage you have.
The state of Iowa does not require drivers to have UI/UIM coverage on their policies. We recommend that all drivers in Iowa carry this coverage. That way, if you are hit by an uninsured or underinsured driver, you can still file a claim for damages with your own insurance company.
But if you don't have UI/UIM coverage, your options are limited. You can seek to recover any damages not paid by insurance in a lawsuit against the negligent driver. But the driver may have limited assets, and if you win the case, it could be years before you actually receive compensation.
A Firm That Gets Results
If the driver who caused your accident was underinsured, you can seek compensation from that driver's insurance company. But the insurance company will still try to dispute your claim. Even your own insurance company may try to pay you a lower amount. Car accident attorneys Jason Ausman and Michelle Epstein used to work on behalf of insurance companies. They know what tactics insurance companies use to deny and reduce claims - and how to beat them.
Our firm knows how to build a strong legal case that gets the attention of insurance companies. We are usually able to get them to the negotiating table and make a favorable settlement offer. But if the insurance company doesn't want to negotiate, we're ready to take them to court. We love to litigate, and we're proud of our victories on behalf of injured clients.
